Terms of Service

This is a working draft provided for the appealstack early-access program and should be reviewed by legal counsel before launch.

1. Agreement to terms

These Terms of Service ("Terms") govern your access to and use of the appealstack website and platform (the "Service"), operated by Populus Technology. By using the Service, you agree to these Terms.

2. Use of the Service

You may use the Service only in compliance with these Terms and all applicable laws. You are responsible for the accuracy of the data your firm enters and for maintaining the confidentiality of your account credentials.

3. Accounts

You must provide accurate information when creating an account and keep it up to date. You are responsible for activity that occurs under your account and for the actions of users you invite.

4. Early access and pilot program

The Service is offered on an early-access basis. Features may change, and pilot terms, including partner pricing, are set out in a separate agreement. Early-access functionality is provided "as is" while the product is under active development.

5. Customer data

Your firm retains ownership of the data it submits to the Service. You grant us the limited rights needed to host, process, and display that data to operate the Service and to configure it to your firm. We handle data as described in our Privacy Policy.

6. Integrations

The Service can connect to third-party tools you choose, such as QuickBooks or other accounting software. Your use of those tools is governed by their own terms, and we are not responsible for third-party services.

7. Fees

Fees, billing frequency, and payment terms are described in your order or pilot agreement. Unless stated otherwise, fees are non-refundable except as required by law.

8. Intellectual property

The Service, including its software, design, and content (excluding your firm's data), is owned by Populus Technology and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks or branding.

9. Disclaimers

The Service is provided "as is" without warranties of any kind. appealstack is a workflow and record-keeping tool and does not provide legal, tax, or accounting advice.

10. Limitation of liability

To the maximum extent permitted by law, Populus Technology will not be liable for indirect, incidental, or consequential damages arising from your use of the Service.

11. Termination

You may stop using the Service at any time. We may suspend or terminate access for violations of these Terms. On termination, you may request export of your firm's data for a reasonable period.

12. Changes to these terms

We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above, and continued use of the Service constitutes acceptance.
